Terms & Conditions – Africa Holiday Safaris

  1. Agreement to Terms These Terms and Conditions constitute a legally binding agreement between you (“the Client”) and Africa Holiday Safaris (“the Company”). By confirming a booking with us, you acknowledge that you have read, understood, and agree to be bound by these terms. Please review this document carefully.
  2. Booking and Payments A. A non-refundable deposit, the amount of which will be specified at the time of booking, is required to secure your reservation. B. The final balance is due no later than [60] days prior to the scheduled departure date. Bookings made within this period require full payment at the time of confirmation. C. We accept payments via bank transfer, credit/debit card, and other methods as specified on your invoice. D. All prices quoted are subject to change without prior notice due to factors beyond our control, such as fluctuations in currency exchange rates, government taxes, or park fee increases. The price is only guaranteed once full payment has been received.
  3. Cancellations and Refunds All cancellation requests must be submitted in writing. The following cancellation fees apply, based on the date of receipt of your written notification: A. Cancellation 90] days or more before departure: Loss of deposit. B. Cancellation between [89] and [45] days before departure: [50%] of the total tour cost will be forfeited. C. Cancellation less than [45] days before departure: 100% of the tour cost will be forfeited (no refund). D. Any applicable bank transfer fees or credit card processing fees will be deducted from any refund amount.
  4. Travel Documents A. It is the sole responsibility of the Client to ensure they are in possession of a valid passport (with at least six months’ validity from the date of return), all necessary visas, and any required health documentation (e.g., vaccination certificates). B. Africa Holiday Safaris is not responsible for any costs, delays, or denial of entry incurred as a result of the Client’s failure to possess valid travel documents.
  5. Travel Insurance A. Comprehensive travel and medical insurance is mandatory for all clients booking a tour with us. B. It is the Client’s responsibility to purchase insurance that provides adequate cover for the entire duration of their trip, including but not limited to medical expenses, emergency evacuation and repatriation, cancellation or curtailment of the tour, and loss or damage of personal belongings. C. The Company accepts no liability for any loss, injury, damage, or medical emergency that may arise.
  6. Limitation of Liability A. Africa Holiday Safaris shall not be held liable for any injury, damage, loss, accident, delay, or irregularity which may arise from acts or defaults of any company or person engaged in providing services for the tour. B. The Client acknowledges the inherent risks associated with adventure travel and safaris in Africa. Participation in all activities is at the Client’s own risk. C. The Company is not responsible for any unforeseen circumstances beyond our control (“force majeure”), such as war, civil unrest, natural disasters, extreme weather, or government actions.
  7. Changes to Itineraries While we will make every effort to adhere to the confirmed itinerary, the Company reserves the right to alter itineraries or arrangements due to unforeseen circumstances (e.g., road conditions, weather, or safety concerns). In such events, we will provide the best possible alternative of a similar standard.
  8. Complaints and Disputes A. Should you have a complaint during your trip, please inform your guide or a company representative immediately to allow us the opportunity to resolve the issue on the ground. B. If the matter is not resolved, any further complaint must be submitted in writing to our Nairobi office within 30 days of the tour’s completion. C. These Terms and Conditions are governed by the laws of the Republic of Kenya, and any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts.
